State Board of Workers' Compensation Form Changes

We always take the time to update you on important changes to Statutes and Board Rules that go into effect on July 1st after each legislative session. The State Board of Workers’ Compensation has been busy updating some of the many Board Forms that you use regularly as well. These forms, like the legislative changes, have gone into effect on July 1, 2023, and a few are important to our daily operations on both an employer and insurer level. It is important to note that the failure to use correct versions of Board Forms could lead to the return of the form you are trying to file beginning October 1, 2023. These changes are a portion of a larger effort to move to electronic/fillable format documents that have greater ease of use for employers and claims specialists. 

We have referenced below the changes to the Forms that are likely to be of most importance to you. There are a number of additional changes to other forms not so frequently used and we invite you to review those on the Board’s website here. The current version of all Board Forms, including those referenced below, can be found on the Board’s website here.

 

FORM CHANGES – EFFECTIVE JULY 1, 2023:

WC-P1 PANEL OF PHYSICIANS English/Spanish: Changed the format on the form from boxes to lines across the page. Lines for more than six physicians are provided if needed. Additional physicians can still be added on a separate sheet. A check box is added to indicate when a separate sheet is added. Added a line for Insurer Email. Added a couple of lines of instructions for the injured workers. No substantive change was made to this form. The number of physicians required to be on the panel of physicians remains at six. 

BILL OF RIGHTS English/Spanish: Updated the TTD benefits maximum to $800 and TPD benefits maximum to $533. Updated the death benefits TTD benefits maximum to $800. Updated widowed spouse maximum amount from $290,000 to $320,000. 

WC-2 NOTICE OF PAYMENT OR SUSPENSION OF BENEFITS: Updated the TTD benefits maximum to $800 and TPD benefits maximum to $533 on back of form in section B.

WC-2A NOTICE OF PAYMENT OR SUSPENSION OF DEATH BENEFITS: Updated the TTD benefits maximum to $800 under Death Benefits on second page.

WC-PMT: Section C – added “and the treatment or testing provider” after the authorized medical provider. In Section E added “and the treatment or testing provider.” after the authorized medical provider.
